Terms of Service

Last updated: October 4, 2026

PLEASE READ THESE TERMS CAREFULLY

By accessing or using our Services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our Services. These terms contain important information about your rights and obligations, limitations of liability, and dispute resolution procedures.

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your use of the Strait Passage website, mobile applications, and booking services (collectively, the "Services") operated by Strait Passage ("Company," "we," "our," or "us").

By creating an account, making a booking, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of the Services after any changes constitutes acceptance of the modified Terms.

2. Our Role as Booking Agent

IMPORTANT: Strait Passage acts solely as an intermediary booking agent between you and third-party transportation providers, including but not limited to ferry operators, airlines, charter companies, ground transportation services, and related travel providers (collectively, "Service Providers").

When you make a booking through our Services, you enter into a direct contractual relationship with the relevant Service Provider(s). We facilitate the booking process and payment collection on behalf of Service Providers but are not the actual provider of transportation services.

Each Service Provider has its own terms and conditions, cancellation policies, and operational procedures that apply to your booking. By making a booking, you agree to be bound by the applicable Service Provider's terms in addition to these Terms.

We do not own, operate, manage, or control any vessels, aircraft, vehicles, or transportation equipment used to provide the services you book.

3. Booking Terms

3.1 Booking Process

All bookings are subject to availability and confirmation. A booking is confirmed only when every included service has operator acceptance and you receive the final journey confirmation. A payment receipt or request reference alone does not confirm the journey. We reserve the right to decline any booking at our discretion.

3.2 Accuracy of Information

You are responsible for ensuring all information provided during the booking process is accurate, complete, and current, including:

  • Passenger names (must match travel documents exactly)
  • Passport and travel document details
  • Contact information
  • Special requirements or accessibility needs
  • Number of passengers and baggage

Errors in passenger information may result in denied boarding, additional fees, or cancellation without refund. We are not responsible for consequences arising from inaccurate information provided by you.

3.3 Travel Documents

You are solely responsible for obtaining and maintaining valid passports, visas, and any other travel documents required for your journey. Requirements vary by nationality and destination. We recommend checking entry requirements well in advance of travel. Denied entry or boarding due to inadequate documentation is your sole responsibility.

3.4 Check-in and Boarding

You must arrive at the departure point by the time specified in your booking confirmation. Failure to check in or board on time may result in forfeiture of your booking without refund. Minimum check-in times vary by service type and provider.

4. Pricing and Payment

4.1 Prices

All prices displayed are in US Dollars (USD) unless otherwise indicated. Prices include applicable taxes and fees unless separately itemized. Prices are subject to change without notice until a booking is confirmed. Once confirmed, the price is guaranteed except as provided in these Terms.

4.2 Payment

Full payment is required at the time of booking unless otherwise specified. We accept major credit and debit cards. Payment is processed securely through our PCI-compliant payment processor. By providing payment information, you represent that you are authorized to use the payment method.

4.3 Currency and Fees

Your bank or card issuer may charge additional fees for currency conversion or international transactions. These fees are your responsibility and are not included in our pricing.

4.4 Price Errors

In the event of an obvious pricing error, we reserve the right to cancel the booking and refund any payment made. We will notify you promptly and offer the opportunity to rebook at the correct price.

4.5 Last-Minute Booking Surcharge

LAST-MINUTE BOOKING POLICY

Bookings made less than 48 hours before the scheduled travel date are subject to a 100% surcharge (2x the standard rate).

Last-minute bookings require significantly more coordination and logistical effort on our part. When a booking is placed within 48 hours of travel, our team must undertake urgent arrangements including:

  • Priority coordination with Service Providers to confirm availability on short notice
  • Expedited processing of passenger manifests, customs documentation, and port authority notifications
  • Emergency scheduling of ground transportation, meet-and-greet staff, and transfer logistics
  • After-hours communication with vendors and operators who may require additional fees for rush arrangements

The surcharge reflects the real additional costs and operational demands of accommodating short-notice travel. The standard rate and the surcharge-adjusted rate are both clearly displayed at the time of booking so you can make an informed decision.

To avoid the surcharge, we recommend booking at least 48 hours before your intended travel date. This also gives us more time to keep your booking coordinated end to end.

5. Cancellations, Rebooking, and Refund Policy

Payment is recorded separately from operator acceptance. We will provide an update within 24 hours of payment. Your journey is confirmed only after every included service has been accepted by its operator. An alternative itinerary requires your agreement. A refund request or agreement is not evidence that the refund has completed.

CANCELLATION AND SUPPLIER CONFIRMATION

Customer cancellations are normally non-refundable. If a purchased service cannot be supplied, we will offer an alternative or a refund option with your agreement. This exception takes precedence over the no-refund statements below. In other cases, in lieu of refunds, we offer rebooking assistance as described below. We strongly recommend purchasing comprehensive travel insurance to protect your investment against unforeseen circumstances.

5.1 Customer-Initiated Cancellations

We understand that plans can change. However, because we pre-arrange and coordinate services with multiple vendors on your behalf — often well before your travel date — cancellations initiated by the customer are non-refundable regardless of timing or reason.

This applies to all service types including ferry crossings, charter flights, ground transportation, VIP services, and package bookings. Once a booking is confirmed, the full booking value is committed to our Service Provider network to secure your arrangements.

If you need to cancel, please contact us as early as possible. While we cannot offer a refund, we may — at our sole discretion and subject to availability — be able to apply your booking value as a credit toward a future rebooking. Rebooking credits are valid for 90 days from the original travel date and are subject to availability and any applicable fare differences.

5.2 Service Provider Delays and Disruptions

Travel in the Caribbean can occasionally be affected by weather, mechanical issues, or operational changes beyond anyone's control. If your booked ferry, flight, or transfer is delayed or cancelled by the Service Provider:

  • We will make every reasonable effort to rebook you on the next available departure or service. Our team actively monitors schedules and will work directly with operators to get you to your destination as quickly as possible.
  • Rebooking onto an alternative service is provided at no additional cost to you, subject to availability.
  • If no same-day alternative is available, we will work with you to arrange travel on the next operating day at no extra charge.

Please note that while we commit to best-effort rebooking, we are not liable for any consequential costs arising from the disruption, including but not limited to missed connections, accommodation, meals, or alternative transportation you arrange independently. The alternative-or-refund option above applies when a purchased service cannot be supplied — our commitment is to get you where you need to go.

5.3 Arrival Date Changes Due to Cancellations

If your inbound flight or ferry to the region is cancelled by the airline or operator and you arrive on a different day than originally planned, we understand the situation is outside your control.

In these cases, we will do our best to accommodate your revised travel date and rebook your Strait Passage services accordingly, subject to availability. Please notify us as soon as you become aware of any change to your arrival plans so we can begin coordinating with our Service Providers.

Accommodation of revised dates is provided on a best-effort basis and cannot be guaranteed, particularly during peak travel periods. The sooner you contact us, the more options we can explore on your behalf.

5.4 Schedule Changes

Service Providers may adjust departure times or routes due to operational needs. We will notify you of any significant changes as soon as we are informed. Minor schedule adjustments (less than 2 hours) are a normal part of Caribbean travel and do not constitute grounds for cancellation or rebooking.

5.5 No-Shows

Failure to appear at the designated departure point by the required check-in time without prior notice constitutes a "no-show." No-shows forfeit the entire booking value and are not eligible for rebooking credits or future accommodation. If you are running late, please contact us immediately — we cannot guarantee we can hold your spot, but we will do our best to assist.

5.6 Rebooking and Date Changes

Requests to change your travel date, time, or other booking details should be made as early as possible and are subject to availability. Rebooking may incur additional fees if the new arrangement involves different services, routes, or higher-cost options.

All rebooking requests are handled on a case-by-case basis. We will always try to find a solution that works, but we cannot guarantee that your preferred alternative will be available. Where a rebooking results in a fare difference, the additional amount is your responsibility.

5.7 Travel Insurance

Given our no-refund policy, we strongly recommend that all travelers purchase comprehensive travel insurance that covers trip cancellation, interruption, and delay. Travel insurance can provide the financial protection that our booking terms do not. This is especially important for travelers making last-minute arrangements or traveling during hurricane season (June through November).

6. Limitation of Liability

PLEASE READ THIS SECTION CAREFULLY

This section limits our liability to you. By using our Services, you agree to these limitations.

As a Booking Agent: Strait Passage is not liable for any acts, errors, omissions, representations, warranties, breaches, negligence, or misconduct of any Service Provider, including but not limited to:

  • Delays, cancellations, or schedule changes
  • Overbooking or denied boarding
  • Loss, theft, or damage to baggage or personal property
  • Personal injury, illness, or death
  • Quality of service or failure to provide advertised services
  • Service Provider bankruptcy or financial default
  • Failure to honor reservations or future travel credits

No Consequential Damages: Under no circumstances shall Strait Passage be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Lost profits or business opportunities
  • Cost of alternative transportation
  • Missed connections or events
  • Hotel, meal, or other accommodation expenses
  • Emotional distress or inconvenience

Maximum Liability: In any event where liability cannot be fully excluded under applicable law, Strait Passage's total liability shall not exceed the service fees actually received by Strait Passage for the specific booking giving rise to the claim, excluding amounts passed through to Service Providers.

Service Provider Liability: Claims regarding the actual transportation services should be directed to the applicable Service Provider. Transportation providers typically limit their liability under international conventions (e.g., Athens Convention for sea travel, Montreal Convention for air travel) and their own terms of carriage.

7. Force Majeure

Neither Strait Passage nor any Service Provider shall be liable for failure or delay in performing obligations due to circumstances beyond reasonable control, including but not limited to:

  • Severe weather, hurricanes, tropical storms, or natural disasters
  • Acts of God, earthquakes, flooding, or volcanic activity
  • War, terrorism, civil unrest, or military action
  • Government actions, border closures, or travel restrictions
  • Epidemics, pandemics, or public health emergencies
  • Strikes, labor disputes, or work stoppages
  • Equipment failure, mechanical breakdown, or technical issues
  • Port or airport closures
  • Fuel shortages or supply chain disruptions

In such events, we will make reasonable efforts to provide alternatives or reschedule. If a purchased service cannot be supplied, the alternative-or-refund option above applies. We do not promise compensation for consequential losses.

8. User Responsibilities

By using our Services, you agree to:

  • Provide accurate and complete information for all bookings
  • Maintain valid travel documents for all passengers
  • Comply with all applicable laws, regulations, and customs requirements

  • Keep your account credentials secure

9. Indemnification

You agree to indemnify, defend, and hold harmless Strait Passage, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Any inaccurate information you provide
  • Any dispute between you and a Service Provider
  • Any claims by other passengers in your booking

10. Intellectual Property

11. Dispute Resolution

11.1 Informal Resolution

Before initiating formal dispute resolution, you agree to contact us at support@straitpassage.com to attempt informal resolution. Most disputes can be resolved through direct communication.

11.2 Arbitration Agreement

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of our Services shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Miami, Florida, USA, or at a mutually agreed location.

11.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

11.4 Time Limitation

Any claim arising from or relating to these Terms or our Services must be filed within one (1) year after the cause of action accrues, or the claim shall be permanently barred.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

14. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Strait Passage regarding your use of our Services. These Terms supersede all prior agreements, communications, and understandings, whether written or oral.
